A large part of our practice is helping clients as they buy or sell a home, land or commercial property. There are a number of areas where our legal services can be of particular value:
  • Most important is the negotiation, preparation or review of the real estate contract and to identify specific risks and areas of concern for a buyer or a seller so that the goals and expectations can be met by the contract. We often work with Realtors to review and refine standard form contracts to best achieve the needs of the individual client.
  • The second area where legal issues can arise is in the due diligence process. As a buyer investigates the property, we serve as counsel for questions and concerns. Most importantly, we review title commitments and surveys and assist the buyer in understanding the property and identifying any title or survey conditions that create unmarketable title or an unacceptable risk.
  • The third area in the real estate sale process where legal assistance is helpful is during the closing process. We review the final deed and closing documents and often draft additional documents that may be needed to address items that have arisen during the sale negotiation and due diligence, such as escrow agreements, warranties, and easements.
  • Finally, we work with buyers and sellers when the real estate sale goes awry, whether than means enforcing the contract, seeking damages or obtaining a return of earnest money.
